In May 2017, the Department of Licensing and Regulatory Affairs approved the first of four minimum standards for indigent criminal defense systems in the State of Michigan under the Michigan Indigent Defense Commission Act (MIDC Act). These standards involve education and training, the initial client interview, experts and investigators, and counsel at first appearance in front of a judge or magistrate.
Under the MIDC Act, each trial court funding unit of local “system” was given the opportunity to select its desired indigent defense delivery method to comply with the MIDC standards. The 43rd District Court and the City of Madison Heights opted for a program to be managed by a contracted Assigned Counsel Administrator who will oversee all administration of this program and control an assigned counsel list with contract attorneys. This plan was approved for implementation, and the City of Madison Heights, on behalf of the 43rd District Court, is now seeking proposals from qualified attorneys for consideration to be the 43rd District Court’s contracted Assigned Counsel Administrator to oversee the implementation of the program and to manage the program going forward.
