Specifications include, but are not limited to: The District intends to enter into a contractual relationship with company for Auctioneering Service to coordinate the sale of the District’s obsolete and surplus material. 1.3.1 The Contractor will take delivery of the equipment and material from the District at the pickup points specified by the District and deliver the equipment and material to the storage area. The Contractor is to take possession within two weeks after notification by the District of the need for a pickup. The title and risk of loss and damage to the equipment and material shall pass to the Contractor upon delivery. This liability shall be equal to the value entered on the Bid Form, Part B. 1.3.2 The Contractor will designate and authorize a representative to act as their agent in all matters relating to the Contract with the District. The representative will prepare the equipment and material on the Contractor’s premises for an auction sale using a mutually agreed to auctioneer. It will be the Contractor’s obligation to pay the auctioneer without reimbursement from the District. 1.3.3 The Contractor is responsible for the cost of all parts, equipment, goods and services needed to prepare the equipment and material for the auction sale without reimbursement from the District. These services may include, but are not limited to mechanical repairs, repainting, and cleaning. 1.3.4 The Contractor is responsible for providing to the District a detailed reconciliation of all transactions. Payment of revenues, including payment of all auctioneer’s commissions or fees, is the responsibility of the Contractor. All costs associated with pickup and storage of the equipment and material are also the Contractor’s responsibility. 1.3.5 The Contractor is responsible for strict compliance with RSMo Section 307.380, including but not limited to completion of a “Junk, Salvage or Rebuilding Affidavit” when necessary, and compliance with any other statutory provision pertaining to the resale of vehicles. 1.3.6 The Contractor shall act as an auctioneer and agent of the District and as such shall stand in a confidential and fiduciary relationship with the District. Until such time as the Contractor pays over to the District the gross auction sale amount less commissions, such funds are to be placed into custody of the Contractor specifically for application to the amount due the District for payment of the auction proceeds.
