Specifications include, but are not limited to: 1. The Minnesota State Forest Nursery requires a Contractor to supply labor necessary to count and grade up to approximately 2.0 million conifer seedlings and 500,000 hardwood seedlings over a ten to twenty working day period in mid-April to mid-May 2020. 2. The Contractor shall comply in every respect with all applicable laws of the federal government and the State of Minnesota. 3. Lifting and grading activities will start when the Nursery is able to lift seedlings without causing frost damage. This typically occurs between April 1 and April 25. The Project Supervisor, or their delegate, will notify the Contractor of the actual start date at least five days in advance. Labor must be available every week day (Monday-Friday) until counting and grading is complete. 4. The State does not guarantee the exact number of seedlings bid upon in this contract. The Contractor must accept that some substitution of seedling species and stock type may be necessary. The State will not be held liable for payment of seedlings contracted but not available for counting/grading due to the State’s inability to lift stock or due to weather conditions. 5. All prospective bidders are strongly encouraged to contact the Project Supervisor before submitting bids. 6. The Contractor must be of legal age. If minor students are used on crews, they can only work on holidays, weekends, and after school hours. If minors are used, all rules, requirements, and regulations of the Child Labor Act, Minnesota Statue 181A, must be complied with and shall be enforced by the State. 7. The Contract Supervisor may terminate this Contract at any time for just cause, citing reasons in writing. 8. No work shall commence on the contract until Contractor receives Notice to Proceed.
