Specifications include, but are not limited to: Perform all the research and analysis necessary for the Agency to determine its fair share objectives in accordance with, and pursuant to, 40 CFR Part 33. Develop a legal framework for the Availability Analysis study, including but not limited to addressing and harmonizing the requirements of EPA’s DBE procurement objectives with the U.S. Supreme Court decision Adarand Constructors, Inc. v. Pena, 515 U.S. 200 (1995); see EPA Final Rule Summary, at 73 Fed. Reg. (2008). Develop a Step 1 “base figure” pursuant to 40 CFR 33.405(b). The report must specify which option under 40 CFR 33.405(b) the firm used to calculate the Step 1 “base figure”. Please note that, if the firm uses 40 CFR 33.405(b)(4) Alternative Methods, the method is subject to EPA approval. (Bidders should note that, in the event that EPA’s approval of the Alternative Methods is delayed, the Agency will work with the Contractor to modify the project management timelines to the extent required.)
