Specifications include, but are not limited to: Investigative duties related to KDE shall include but are not limited to: investigating matters on behalf of the Commissioner of Education pursuant to KRS § 156.210(1)-(2) involving school district board members, superintendents of schools, or other public school officers in which allegations of immorality, misconduct in office, incompetency, willful neglect of duty, or nonfeasance are alleged; interviewing and/or taking sworn statements from all necessary individuals in the course of these investigations; gathering and reviewing all relevant evidence including, but not limited to papers, books and records of teachers, superintendents, or other public school officials; providing updates to the Commissioner, General Counsel, and/or designee; preparing final investigative reports; making recommendations in consultation with the Office of Legal Services regarding criminal referrals to county attorney or the Commonwealth's attorney pursuant to KRS 156.210(3); making recommendations in consultation with the Office of Legal Services regarding removal of any superintendent of schools, principal, teacher, member of a school council, or other public school officer as appropriate pursuant to KRS 156.132; providing testimony as necessary before civil or administrative bodies, including the KY Board of Education (KBE) that may result from the investigation.
