Specifications include, but are not limited to: . General Search Specifications 1. Contractor shall comply with the General Instructions for Preparation of Searches provided above. 2. Contractor shall properly label every search with parcel number and item number. 3. The search shall certify to the current ownership, hereinafter also referred to as grantor(s), and contain the actual legal description as shown on the recorded instrument of conveyance that vested title in the current fee owner. 4. The search should show the marital status, if such status is discovered during search, or appropriate representative capacity of the grantor(s) as related in the instrument vesting title, and should explain the manner in which title was vested, i.e., type of deed, affidavit, or legal action, and including the corresponding recorded information. 5. Any sell-offs, (any grant of a parcel or portion of a parcel) consummated after the vesting of title in the grantors of the aforementioned description should be identified as sell-offs and made exceptions to the search. 6. Search shall include a search of the Lis Pendens Record and an appropriate reference to and description of any listed pending action. 7. Search shall include an appropriate reference to contracts, leases, liens, and mortgages of record which affect subject real estate and should be described with recording/filing dates and relevant instrument/record numbers. 8. Leases, contracts, liens, and mortgages of record which affect subject real estate, but which have a description different from that shown in the caption of the search, should be described with recording/filing dates and relevant instrument/record numbers to allow proper determination as to the location of same. 9. Search shall not include description of or appropriate reference to easements, rights-of-way, or liens in favor of the State of Indiana. 10. “Update” shall mean the updating of a search furnished to the County and conforming to all the requirements as set out in the original search. There shall be no charge for the issuance of an update ordered within onehundred, eighty (180) days of the effective date of the original search.
