Defense costs must be included in the policy and are in addition to coverage limits. 2. The counsel to defend any covered claim must be mutually agreeable between insurance company and the insured. 3. The insurance company shall not settle any claims without the insured’s written consent. 1. Defense costs and expenses are in addition to the coverage limits. 2. The insurance company shall not settle any claim without the insured’s written consent. 3. Claims shall be covered on a “claims made” basis, only if the first knowledge of a potential claim is within the coverage period. 4. Both the insurance company and the insured must mutually agree on counsel selected to defend any claim. Exclusions: This coverage does not apply to: 1. Personal profit gained by a Member to which the Member was not entitled. For example, costs incurred by any Member for goods, services or equipment necessary to provide any student with a free appropriate public education. 2. A claim brought about by dishonest acts of a Member. 3. Any claim, direct or consequential, arising from bodily injury, sickness, disease, death or property damage. 4. False arrest, detention, imprisonment, libel, slander, defamation, assault and battery, or invasion of privacy. 5. Absolute pollution exclusion. 6. Modification to property to accommodate disabled persons.
