Electronic bids for the construction of the 2023 STREET IMPROVEMENTS PROJECT, will be received by CITY OF FERGUSON until THURSDAY, AUGUST 17th, 2023 at 11:00am. Electronic bids should emailed to kgilber@fergusoncity.com and wdg@weisdesigngroup.com. A link to attend the virtual bid opening will be emailed out to all plan holders at a later time at which time they will be publicly opened and read aloud. Bids received after said time will be unopened.
The proposed work includes the furnishing of materials, tools, equipment and labor necessary for the removal and replacement of 4,500 square yards of concrete pavement slabs, 3,500 square yards of milling, and 2,000 tons of BP1 asphalt overlay with fibers in accordance with the specifications and other items identified in the contract documents.

Each bid must be accompanied by a Bid Bond executed by the BIDDER and an approved surety company and payable to the CITY, in an amount not less than five percent (5%) of the sum total of the base bid.
Not less than the prevailing hourly rates of wages that the higher of State or Federal Wage Rates shall prevail, or determined by court on appeal, shall be paid to all workers performing work under this Contract.
All BIDDERS must meet the MoDOT requirements as a CONTRACTOR prior to bid opening in accordance with the Missouri Standard Specification Book for Highway Construction and Metropolitan St. Louis Sewer District (MSD) Standard Construction Specification Dated 2009.
A Performance Bond and Payment Bond are required.
No trainee hours are required under this contract.
City of Ferguson hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, businesses owned and controlled by socially and economically disadvantaged individuals will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religion, creed, sex, age, ancestry, or national origin in consideration for an award.
In accordance with the Davis-Bacon Act, and the Missouri Prevailing Wage Law, the Contractor will be required to comply with the wage and labor requirements and to pay minimum wages in accordance with the schedule of wage rates established by the United States Department of Labor and the Missouri Division of Labor Standards, respectively. The highest rate between the two (Federal and State) for each job classification shall be considered the prevailing wage.
No bid may be withdrawn within thirty (30) days after the scheduled closing time for receipt of bids. The City will only concur with awarding the contract to the "lowest, responsive, responsible bidder".
The bidder, having examined and being familiar with the local conditions affecting the work, and the contract, contract documents, including the Missouri Highways and Transportation Commission’s “Missouri Standard Specification for Highway Construction, 2011" and most current supplement, and “Missouri Standard Plans for Highway Construction, 2009”, and “Standard Construction Specifications for Sewers and Drainage Facilities Metropolitan St. Louis Sewer District, 2009” for all storm water control, and their revisions, and the request for bid, including appendices, the special provisions and plans, hereby proposes to furnish all labor, materials, equipment, services, etc., required for the performance and completion of the work. All references are to the Missouri Standard Specifications for Highway Construction, as revised, unless otherwise noted.
Bidders are informed that pursuant to Section 285.530, RSMo, as a condition of the award of any contract in excess of five thousand dollars ($5,000.00), the successful bidder shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection to the contracted services. Successful bidders shall also sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection to the contracted services (E-Verify).
Missouri law, 292.675 RSMo, requires the Contractor and its subcontractor(s) to provide a ten-hour occupational safety and health administration (OSHA) construction safety program (or a similar program approved by the Missouri Department of Labor and Industrial Relations as a qualified substitute) for their on-site employees (laborers, workmen, drivers, equipment operators and craftsmen) who have not previously completed such a program and are directly engaged in actual construction of the improvement (or working at a nearby or adjacent facility used for construction of the improvement). The Contractor and its subcontractor(s) shall require all such employees to complete this ten-hour program, pursuant to 292.675 RSMo, unless they hold documentation on their prior completion of said program. Penalties for non-compliance include Contractor forfeiture to the City of City of Ferguson in the amount of $2,500, plus $100 per contractor and subcontractor employee for each calendar day such employee is employed beyond the elapsed time period for required program completion under 292.675 RSMo.
Be advised that contracts over $250,000 or containing iron or steel trigger Build America Buy America (BABA) provisions requiring that materials be sourced to manufacturers within in the United States. Documentation must show that the contractor was able to source materials to United States’ manufacturers or that materials and products subject to this preference are not produced within the United States or cannot be produced in sufficient quantity and quality. Bids that include United States’ sourced material will be preferred if the total price of the bid response is within 25% of the lowest bid. In cases where BABA compliance is not achieved, contractors and subcontractors must document good faith efforts to comply.
